Conditions for protection in Morocco
Novelty
The design or model must not have been disclosed to the public prior to filing, except in the case of international exhibitions, which benefit from a 6-month grace period.
Distinctive Character
The design must clearly stand out from existing creations.
Legal Exclusions
The following cannot be protected: creations that are contrary to public order or morality, official signs, state emblems, or currency without authorization.
Procedure for Filing an Industrial Design and Model
- File Preparation: application form + graphic reproductions or photographs + payment of fees.
- Filing with OMPIC: a receipt is issued with a filing number and date.
- Formal Examination: Verification of administrative compliance.
- Registration: Issuance of the registration certificate.
- Publication: Entry in the national register and official publication.
Duration and Renewal of Protection
Protection is valid for 5 years from the filing date.
It can be renewed twice, for a maximum duration of 15 years.
Renewal must be requested within 6 months before expiration, with a 6-month grace period available.
